Homophobes continue to throw legislative temper tantrum
Well, the bill to prevent federal judges from ruling that a marriage performed in one state must be recognized by another--but only if it's a same sex marriage, of course--passed in the House. This article says that it won't get passed in the Senate, that it's just a big show so that Republicans can assure the religious wackos that they have no respect for our judicial system, unless of course the judicial system comes around to making rulings based on bigotry instead of consitutional law.
Even though it won't likely become law, this sort of thing should seriously concern all Americans, even those who oppose same-sex marriage. I don't know how many times Congress has ruled in the past to remove certain powers from the judicial system that exist to keep Congress's power in check, but any time is one too many. Now I'm no expert in constitutional law, but it seems to me to be a direct violation of the checks and balances system for one branch to make laws shielding it from being checked by another.
If this is what it looks like, then opponents of same-sex marriage should be insulted. They are being mobilized so that Congress can make a naked power grab. Congress should not be able to create a law that protects another law from judicial oversight, like some sort of magic charm or something.
I'm not overly concerned--it's clearly an unconstitutional law, and yes, while it will have to be thrown out before the Defense of Marriage Act is thrown out as unconstitutional, it's just a matter of time and ACLU lawsuits.
