The FEC has been sicced on Kos

I know Daily Kos has already noticed this. However, I first saw this on Media Girl. Seems like the FEC has decided that "bloggers" are getting too much money to candidates. So the plan is to count links to campaign websites from your own website as a political donation.

This is more than an attack on free speech. This is a big "fuck you" to the very idea of democracy. Bloggers are ordinary citizens and we present ourselves as nothing more or less, really. How can it be illegal for an independent person to endorse a candidate?

This is nothing more than a bunch of Republicans using their power to shut down citizen influence on a democratic government. How dare Daily Kos encourage ordinary people to give money to campaigns, thereby enticing the candidates to stand up for the people instead of big money corporate power? FEC Commissioner Bradley Smith:

If someone sets up a home page and links to their favorite politician, is that a contribution? This is a big deal, if someone has already contributed the legal maximum, or if they're at the disclosure threshold and additional expenditures have to be disclosed under federal law.

No word yet on if the FEC will investigate how many millions upon millions of dollars non-citizen Rupert Murdoch spent promoting President Bush's campaign through Fox "News".

Because the main target is Daily Kos. The short term will benefit the Republicans, though the long term mostly benefits corporate donors to both parties.

Do you expect the guy to be forthcoming about his motivations? "Well, we were tired of Daily Kos raising money for politicians that were defeating Republicans and pulling the party back to the left so we figured out a way to shut him down." Yeah...no.

Despite the mainstream media grousing, one of the biggest strengths about blogging is that because of our status as independents without official sponsorship is that we can point it out when we think something is politically motivated or someone is lying if we damn well please. And yes, I think that Kos is the target of this witchhunt. In fact, I think it's obvious.

Right wing complaining is good. They should complain--censorship can come down on their ass one day as well. That some on the right don't trust government censorship either doesn't mean that it isn't a partisan move. And it's definitely an anti-democratic with a small d move.

I'm still not entirely sure who exactly is responsible for what here. We have a judge ruling that the speech restrictions of McCain-Feingold ought to apply to the internet. We have Republican FEC commissioners opposing the ruling, and Democratic FEC commissioners refusing to oppose it. Who exactly made the decision to target Daily Kos (or, who received the call from Karl Rove to do so)? Was it:

1. The judge, Colleen Kollar-Kotelly? If this is the case, can you please explain why you think a Clinton-appointed federal judge with a basically moderate record decided to issue a ruling solely for the purpose of stifling a liberal blog?

2. The Republican commissioners, including Bradley Smith, who opposed the judge's ruling? If this, can you please explain why you think *opposing* a ruling that would restrict speech on the internet is an effective way of stifling a liberal blog?

3. The Democratic commissioners who voted NOT to oppose the judge's ruling (in effect, agreeing that political speech on the internet should be more restricted)? If this, can you please explain why you think Democratic FEC commissioners found it in their interest to stifle a liberal blog?

Thus the reason I didn't mention the word "Democrat" anywhere in the post. I suspected, and I guess should have put in big, bold letters at the top, that the DLC types would be supportive of this move, because it will help keep them in power.

(1) Democrats (and a few moderate Republicans) are the ones who came up with campaign finance reform in the first place; (2) Democrats on the Federal Election Commission are the ones who want to regulate the Internet; (3) Democrat-appointed judges agree; (4) The main Republican involved here -- Bradley Smith -- is one of the biggest free speech advocates on earth, which is precisely why he has been demonized by McCain and Feingold and all the Democrats who want to regulate speech here. (In the linked article, he is just reporting what the Democrats want to do, NOT favoring it himself. You'd see that if you read as far as the 5th paragraph of the article.)

Nice dodge of the issue, which is precisely who was responsible for the targeting of Daily Kos in particular, and how that could possibly be a GOP conspiracy when the only ones in the whole affair that stood against increased control of speech on the net are the GOP commissioners at the FEC.

Life is too short to read mindlessly partisan blogs. I have no love for the Republicans or for Bush, but this is ridiculous. Even the Kos writeup of this piece says Bradley Smith is "good on this issue"! Maybe you should get that jerking problem in your knee looked at.

I'm curious about your view, though. You say "this" is an attempt to cut off funding to hurt citizen involvement. I agree, I think, if you are saying that the effect of enforcing McCain-Feingold in this way will hurt bloggers' and other grassroots internet groups' attempts to raise money for candidates they favor, as well as to help those candidates through buzz, linking, and so forth.

What I really want to know is: do you think the judge is misinterpreting McCain-Feingold, and hence it is HER RULING (and not the law) which is responsible for this invidious effect? Or is it the law itself? If the former I'd love to hear how you think McCain-Feingold is being misinterpreted in the ruling -- because most of the bloggers I've read, both left and right, seem to think that it's the law itself, not this particular ruling, which is the problem.

Tough call. An either/or question like that leaves me in a bind--I either don't feel it's fair or I don't know enough to say. ;)

Actually, it seems both. The bill is all sorts of complicated and hard for us plebians to understand, and to call it "campaign finance reform", while accurate, really set voter expectations way too high, considering politicians aren't about to cut off their funds in a meaningful way.

But I really do think that they didn't see blogging coming and the sudden willingness of ordinary people to do an end run around funding-as-usual. So I'd say both--it was written way too loosely, doesn't go after what people want a reform bill to go after, which is corporate money; and the ruling strikes me as a streeeetch of any original intention behind the law.

Well, I support campaign finance reform if we can see some scorch the earth type laws. Ideally, it would be illegal to donate to a campaign at all and candidates would be given a set amount of free air time to explain their views to the public. Like the debates + a couple of individual speeches.

But there are a couple problems with that idea I'll readily admit to, the biggest one being getting politicians to choke off their own source of funds.
